Clay County continues to cooperate with all legal requests from the State Auditor’s Office. All financial transactions made in the past two years have been turned over as requested to the audit team, including 300,000 lines of data and more than 1,300 pages of documents. This Commission is confident that the constitutional issues brought forward are serious and far-reaching. Government requires accountability at all levels. The County looks forward to a Judge addressing these matters.

The State Auditor agreed to halt taking further action on a subpoena for records from Clay County today. Both the Auditor and Clay County agree that serious constitutional issues surround the Auditor’s subpoena power, for which a judicial opinion is needed. Continued...

Earlier today the Clay County Commission served Missouri State Auditor Nicole Galloway with a lawsuit seeking a declaratory judgment determining the scope of her constitutional authority. On Monday, December 18, the Missouri State Auditor’s staff addressed Clay County officeholders and citizens with preliminary remarks about the scope and process of the audit.
